Case 19-E-0277: Baron Winds Electric Generation Facility


On November 29, 2017, Baron Winds, LLC (Baron Winds/Company) filed an application with the New York Board on Generation Siting and the Environment (Siting Board) to construct a commercial-scale wind power project (Facility) in the Towns of Cohocton, Dansville, Fremont and Wayland in Steuben County, New York. The application was approved by the Siting Board in September 2019.

During the time that the application was under review by the Siting Board, Baron Winds also filed a petition with the New York State Public Service Commission (Commission) seeking a Certificate of Public Convenience and Necessity (CPCN) under Section 68 of the New York State Public Service Law to construct and operate the Baron Wind Facility.

Public Statement Hearing and Procedural Conference

The Commission is holding a public statement hearing to accept public comments on whether granting the requested CPCN is in the public interest. Interested members of the public are invited to attend the hearing and provide comments regarding Baron Wind’s petition and whether the Company is ready and able to exercise its rights. This hearing is not an opportunity to discuss or reexamine the Siting Board’s decision.

An Administrative Law Judge will preside over the hearing and the gathering of public comments. * Comments made at the hearing will be transcribed and become part of the formal record in this proceeding and will be presented to the Commission for its consideration. The Commission may adopt or reject Baron Wind’s petition for a certificate in whole or in part or make modifications.
A procedural conference is scheduled immediately following the public statement hearing. At the procedural conference, the Examiners may determine issues for the evidentiary hearing and establish a case schedule.

Background

On September 12, 2019, in a separate proceeding pursuant to Article 10 of the PSL (Case 15-F-0122), the Siting Board granted Baron Winds the right to construct a 300-MW wind-powered electric generation facility in the Towns of Cohocton, Dansville, Fremont and Wayland, in Steuben County. The Facility will include: wind turbines, access roads, a collection substation, a point of interconnection substation, an operation and maintenance building, and permanent meteorological towers. The Facility will interconnect to the electrical grid at an existing substation on the New York State Electric and Gas 230 kilovolt (kV) transmission line in the Town of Cohocton.

Under PSL Section 68, the Baron Winds Facility will be considered an electric generating plant and is therefore subject to Commission jurisdiction. Section 68 requires that an Applicant for a CPCN provide evidence to the Commission that the proposed facility is in the public interest, economically feasible and that the Applicant can finance the proposed Facility and provide electric service. Additionally, the evidence must show that the Applicant has received all required consents for use of municipal properties and rights-of-way. On April 11, 2019, Baron Winds, LLC filed a petition requesting that the Commission consider issuing a CPCN and issuing an order that finds the Company is a wholesale electric market participant; thereby, entitling it to a lightened regulatory regime for safe, adequate and reliable service.

Comments can be made at the public statement hearing held on February 27, 2020 or submitted through the methods below:

Phillips, Secretary, at secretary@dps.ny.gov or by mail to Secretary Phillips at the New York State Public Service Commission, Three Empire State Plaza, Albany, NY 12223-1350. Comments delivered in these manners should reference the Baron Winds Project (Case 19-E-0277).
    • Via the Department Website: Comments may be entered directly into the case via the www.dps.ny.gov website, by entering the associated case number (19-E-0277) in the Search option found on the homepage. After opening the case, enter comments in the “Post Comments” section located at the top of the page.
    • Call the Toll-free Opinion Line: Individuals may choose to submit comments by calling the Commission’s toll-free Opinion Line at 1-800-335-2120. This line is set up to receive in-state calls 24 hours a day.     All comments will become part of the record considered by the Commission. Although comments will be accepted throughout the pendency of the proceeding, comments are requested by March 26, 2020.
