Cassadaga Wind, LLC (Cassadaga) filed an application seeking approval under Article 10 of the Public Service Law (PSL) to construct and operate a 126 Megawatt (MW) electric generating wind project. The project is proposed to be located in the Towns of Charlotte, Cherry Creek, Arkwright and Stockton in Chautauqua County.
Informational Forum and Public Statement Hearing
On November 28, 2016, the New York State Board on Electric Generation Siting and the Environment (Siting Board) determined that the Application complied with the Siting Board’s filing requirements and thus the hearing process could begin. Interested members of the public were invited to attend a public statement hearing and provide their comments on the proposed Cassadaga Wind Project.
An informational forum was held prior to the start of the public statement hearing and did include a brief overview of the proposed project and the review process by which the project will be brought to the Siting Board for decision. Members of the public did have an opportunity to pose questions and view maps of the proposed project area during this forum.
Administrative Law Judges (ALJs) from the New York State Departments of Public Service (DPS) and Environmental Conservation (DEC) served as Examiners for the proceeding and did preside at the public statement hearing. Comments made at the hearing become part of the formal record in this proceeding and will be presented to the Siting Board for its consideration of the proposed project.
Description of the Project
On March 27, 2016, Cassadaga filed an Application for a Certificate of Environmental Compatibility and Public Need (Certificate) pursuant to Article 10 of the PSL. The Certificate, if granted, would authorize the Company to construct an approximately 126 MW wind-powered electric generating facility located in the Towns of Cherry Creek, Charlotte, Arkwright, and Stockton, New York.

According to the Applicant, the Cassadaga Wind Project will assist in meeting New York’s goal of 50 percent energy generation from renewable sources by 2030. The Application states that operation of the project will not result in any emission of pollutants, but construction and operation may have minor environmental impacts to terrestrial ecology and wetlands, avian and bat species, and agricultural land, as well as impacts to people including noise, traffic and visual impacts.

Summary of the Article 10 Process
There are five phases to the Article 10 process, including pre-application, application, administrative hearings, Siting Board decision and compliance.
Pre-Application: In this phase, an Applicant submitted two documents: a Public Involvement Program (PIP) Plan and a Preliminary Scoping Statement (PSS). The PIP Plan was filed at least 150 days in advance of the PSS and the PSS was submitted at least 90 days before the Application. The Cassadaga Wind PIP Plan was filed in November 2014 and summarizes activities to educate, inform and involve the public in the Article 10 process. The PSS describes information the Applicant proposes to include in the application for this project. The PSS includes a description of the proposed facility and reasonable alternatives, potential significant environmental and health impacts, proposed studies to evaluate the potential impacts and measures to avoid or mitigate the impacts. The Cassadaga Wind PSS was submitted in September 2015.
To ensure public involvement and facilitate communication between the Applicant and interested or affected parties, DPS staff and the Applicant provide opportunities for public participation. In addition, the Applicant paid a fee when it filed the PSS to fund a pre-Application intervenor account. Funding was available to assist intervenor efforts in hiring consultants and lawyers. The Cassadaga Wind Project funds were awarded by the Examiners in October 2015.
